dissertation provides
a comprehensive
review of the alternative dispute
resolution mechanisms in the Energy sec
tor. It begins with the
definition
s
of the
terms “Energy
Sector
” and
“Disputes” .
It is divided into two chapters. The first chapter refers to the disputes that may arise
in the energy Sector and the dispute resolution mechanisms provided. This chapter
begins by indicating
the disputes that may arise in the Energy Sector
and explains
their complexity
. The study
further
analyzes the alternative dispute resolution
technics , that are more preferably used by the participants in the industry
along with
their respective advantages and disadvantages. This chapter concludes by
referring
to
the alternative dispute resolution mechanisms in the Greek
Energy Legislation
and more specific it refers to arbitration next to RAE.
The second chapter is dedicated to the protection of the investment under the
Energy Charter Treaty. It starts with a reference to ECT and more specific it refers to
i
ts
aim.
The study
,
also covers the issue of the promotion
,
protection and treatment of
investments by referring to
all ECT’s provisions that provide for such protection. A
comprehensive analysis of article 26 ECT is made including
the arbitration
procedure that the latter provides to investors
. Finally , important definitions such as those
of the terms “investment” and “investor” are provided. The study concludes by
highlighting the importance of alternative dispute resolution mechanisms in the
energy sector in general and in case of “energy investments”.
