This dissertation was written as part of the LLM in Transnational and European Commercial Law and Alternative Dispute Resolution at the International Hellenic University. The energy sector is widely recognized as being of pivotal importance in contemporary economies. At EU level, the aim of creating an internal market could not leave the energy sector unaffected. Privatization, although not explicitly regulated, seems to be promoted and considered as a necessary tool for a competitive energy market. Multiple implications in different levels, both economic and social, can be outlined. In Greece, there has been, and still continues, a strong debate concerning the privatization of the energy utilities. Unfortunately, the scene remains blur and no satisfactory solution seems to be found. I would like to thank my supervisor, Prof. Th. Panagos, for the understanding he showed over the last weeks. I dedicate this thesis to my father who did not make it till the last page.
